Masons of Yorkshire loses trademark battle

Spirits producer Masons of Yorkshire will not be able to use the Green Vodka name for alcoholic drinks following a dispute with Vlaktor Trading.

Vlaktor Trading owns the trademark for Green Mark Vodka.

Masons was attempting to register the trademark in several categories, most notably for alcoholic drinks.

It also applied to register for non-alcoholic drinks, drinking vessels and flasks, and food and drink services.

Vlaktor Trading argued that the competing marks are “highly similar” and there would be a likelihood of confusion.

In its ruling, the IPO concluded that consumers were likely to confuse a potential Green Vodka with Vlaktor’s Green Mark Vodka and therefore the trademarks would be too similar for products in the alcoholic drinks category.

However, it allowed the application to proceed for drinking vessels, non-alcoholic drinks, catering services, and certain other goods where it found there was no likelihood of confusion.

Masons of Yorkshire produces a range of vodkas and gins.

Recently, it collaborated with mixer brand Franklin & Sons to create a range of ready-to-drink products.
