Crystal Head Vodka revives ‘knock-off’ lawsuit
Globefill Inc has returned to court in a trade dress infringement case against KAH Tequila, claiming the brand, now owned by SPI Group, is a “cheap knockoff” of its own Crystal Head Vodka, reports say.

Both Crystal Head Vodka and KAH Tequila are presented in skull-shaped bottles.
Crystal Head Vodka, which is backed by actor Dan Aykroyd and presented in a glass bottle, launched in 2008. KAH Tequila was founded by Kim Brandi as part of her then Elements Spirits venture in 2009, and is available in ceramic calavera designs.
The new case – being heard by a California federal jury, according to Law 360 – marks the second time Globefill has brought such a case against KAH Tequila.
The previous trial ended in favour of KAH Tequila, which was owned by Elements Spirits at the time.
SPI Group’s Amber Beverage Group took control of the KAH Tequila brand in December 2016.
Seymour Ferreira, CEO of Amber Beverage Group, the SPI Group division which markets KAH Tequila, confirmed that a legal case with Crystal Head Vodka was ongoing, but declined to comment further.
The Spirits Business has also approached Crystal Head Vodka for comment.
