Lawsuits against Tito’s request dismissals

Two lawsuits alleging Tito’s Handmade Vodka is “deceptively labelled” as being made by hand have both requested dismissals.

The suits were filed in US District Court in California in 2014, both seeking class action status and requested refunds (alongside additional conditions) for customers who bought Tito’s products under the pretence they were made by hand.

Both cases have jointly requested the dismissal and will pay their own legal fees, according to court documents seen by My Statesman.

A trial has been scheduled for October 2016.

Following the first suit brought against the brand, Tito’s founder Tito Beveridge said: “We disagree with the claims made against us and plan to defend ourselves against this misguided attack.”

The first suit was weighted largely on a dictionary definition of “handmade”, which states handmade items are “made by hand, not by machine, and typically, therefore of superior quality”.

In September 2015, a federal district judge dismissed five out of six lawsuits against Tito’s Handmade Vodka that accused the brand of false advertising.
