SWA takes Australian drinks maker to court

The Scotch Whisky Association (SWA) is taking legal action against D’Aquino Brothers following allegations the Australian drinks group is selling fake Scotch.

The SWA filed a lawsuit against D’Aquino Brothers earlier this week

In a statement, trade body the SWA said the case against D’Aquino Brothers Pty Ltd “and a number of other parties” was now live.

The SWA is suing the companies “for infringement of our trademark ‘Scotch whisky’”.

“The SWA takes the protection of Scotch whisky extremely seriously,” an SWA spokesperson said. “Wherever the legal requirements that govern the production of Scotch are not being upheld, we will take action.”

D’Aquino’s Brothers produces The Back Scot brand

The lawsuit comes after an investigative report by ABC News stated that results from an international laboratory showed D’Aquino’s The Black Scot brand “[lacked] the unique chemical compounds that identify a true Scotch”.

In addition to The Black Scot, D’Aquino’s Scotch-labelled products include: The MacDougall, JBR, Old McTavish, Old Burn Stewart, Loch Nessy and Royal Crown.

On its website, D’Aquino claims: “Fully imported from Scotland using the finest grains and oak matured, our blending recipe has been handed down through many family generations.”

The Spirits Business has approached D’Aquino Brothers for comment.
